COUNTY OF OAKLAND CHARTER TOWNSHIP OF BRANDON

ORDINANCE NO. 113-11 PENSION PLAN, ADMINISTRATION AND HEALTH CARE AMENDING ORDINANCE

PREAMBLE:

On or about February 5, 2007 the Board of the Charter Township of Brandon adopted Ordinance 113, also known as the "Pension Plan, Administration and Health Care Ordinance" to designate certain benefits available to township employees and designated elected officials upon qualification. The Charter Township of Brandon has now determined that Ordinance 113 must be amended to recognize changing economic conditions and to further address the health, safety and welfare of the citizens of the Township

THE CHARTER TOWNSHIP OF BRANDON, COUNTY OF OAKLAND, STATE OF MICHIGAN, ORDAINS:

SECTION 1: Short Title

Sec. 1.1. This Ordinance shall be known and may be cited and referred to as the Brandon Township Pension Plan, Administration and Health Care Amending Ordinance, and shall hereinafter be referred to as "this Ordinance".

SECTION 2: Scope and Application

Sec. 2.1. This Ordinance shall not interfere with, diminish and/or minimize the effect and force of any other law, ordinance, rule or regulation in effect or hereafter given effect, relating to the same subject matter, except as specifically designated herein.

SECTION 3: Revocation of prior sections

Sec. 3.1. Section 6, Membership Retirement Plan, of Ordinance 113 is hereby revoked in its entirety:

Sec. 3.2. Section 13, Medical Plan, of Ordinance 113 is hereby revoked in its entirety.

Sec. 3.3. Section 14, Extended Coverage, of Ordinance 113 is hereby revoked in its entirety.

SECTION 4: Adoption of Revised Section 6, Membership Retirement Plan

Revised Section 6 of Ordinance 113 is hereby adopted as follows:

Sec. 6. Membership and credited service shall be determined in accordance with the provisions outlined in the MERS Plan Document.

SECTION 5: Adoption of Revised Section 13,

Medical Plan.

Revised Section 13 of Ordinance 113 is hereby adopted as follows:

Sec. 13. Medical Plan. There is hereby created for the township employees and full time elected officials, (excluding trustees) a medical plan. For purposes of such plan the township supervisor and township clerk are hereby authorized to contract in the name of the township (subject to recommendation by the Oversight Committee and approval by the Township Board) with any company authorized to transact such business within the State of Michigan for medical insurance coverage, to the extent consistent with the resolutions of the Township Board.

a. Eligibility. Each employee shall be eligible for coverage while so employed if he/she then meets the following requirements:

1). He or she has completed at least 30 days of continuous employment with the Township

2). His or her age at their nearest birthday is at least eighteen (18) years.

3). He or she is scheduled to be employed 40 or more hours per week for 52 weeks per year

b. Full time elected official (excluding trustees) are eligible for coverage while serving their term of office.

SECTION 6: Adoption of Revised Section 14,

Medical Plan.

Revised Section 14 of Ordinance 113

is hereby adopted as follows:

Sec. 14 Extended Coverage. An extended medical plan is hereby created and established for the Brandon Township full time elected officials (excluding Trustees) and full-time employees. Any such official or employee who has retired with twenty (20) or more continuous years of service and achieved age fifty-five (55) shall have vested continued medical coverage, at the cost of Brandon Township, consistent with the coverage in effect for then current full time employees. When said official or employee becomes eligible for Medicare, a comparable allowance or supplemental coverage to the coverage in effect for then current full-time employees shall be offered.

SECTION 7: Affirmation of all other

provision of Ordinances113.

Sec. 7.1. All provision of Ordinance 113 as adopted February 5, 2007 are hereby affirmed and approved in their entirety except as otherwise provided in this amending Ordinance.

SECTION 8: Severability

Sec. 8.1. In the event any one or more section, provision, phrases, or words of this Ordinance shall be held invalid, void, unenforceable and/or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity, effectiveness or enforceability of the remaining sections, provisions, phrases or words of this Ordinance

SECTION 9: Effective Date and Declaration

Sec. 9.1. This Ordinance is hereby declared and certified to have been duly adopted by the Board of the Charter Township of Brandon, County of Oakland, State of Michigan, at a meeting of the Board duly called and held on the 19th day of December, 2011 and published on December 24, 2011 in the manner prescribed by law. The effective date of this Ordinance is the date of publication.
