Bids are solicited on a completed price listed on the proposal form. The Contract will be awarded to the lowest responsible responsive bidder based upon the lump sum as indicated in the proposals for all the work specified. The Owner reserves the right to increase, decrease or delete selective bid items from base proposal to conform to monies budgeted. The term OWNER shall mean the Charter Township of Brandon and its representatives and the BIDDER/ARCHITECT shall mean any person, firm or corporation who submits a bid or is chosen to perform the work herein.


The work shall include architectural design services to convert the storage room to a computer lab, expand the storage space which includes the extending of the outer walls, raising of the floor level to be equal with the rest of the building, portioning for storage, design the installation of insulation and removing the outside door, running of heat and electrical as necessary to provide internet and phone lines. The design services shall include the designing of and to provide construction documents (plans and specifications) to meet Michigan Building Code 2009 requirements and of sufficient clarity to request contractors to bid the work to be performed as described above.


Any bidder who fails to attend the pre-bid site inspection will be disqualified from bidding this project. The meeting will begin at 9:00 AM local time on Wednesday, February 29, 2012 at 345 Ball Street in the Village of Ortonville, Oakland County, and State of Michigan. The bidder's representative at the meeting shall be solely responsible for insuring the Bidder's name, complete address and phone number appears clearly and correctly on the Township's attendance roster. Any addendums sent out are based on the accuracy of this attendance roster. Any proposal received from a bidder whose name does not appear on the Township's attendance roster may be declared non-responsive and their bid not opened. This meeting is mandatory as there is no specific information available for quantities and all necessary measurements to determine materials necessary are the responsibility of the bidder.


The Contractor and Subcontractors on this project must comply with HUD contract provisions 24CFR part 85.36 (i), the Davis-Bacon Act, Nondiscrimination, Equal Employment Opportunity, Affirmative Action, Section 3 requirements, anti-Kickback Act, Federal Occupational Safety and Health Act and Department of Labor Standards and Regulations as set forth in the Contract Bid Documents. The OWNER reserves the right to accept any Proposal, to reject any or all Proposals, and to waive any irregularities in any Proposal, in the interest of the OWNER.


Proposals which are not signed by the individual making them shall have attached thereto to a Power of Attorney evidencing authority to sign the Proposal in the name of the person for whom it is signed.

Proposals which are signed by a partnership shall be signed by all of the partners or by an Attorney-in-Fact. If signed by an Attorney-in-Fact, there shall be attached to the Proposal a Power of Attorney evidencing authority to sign the Proposal, executed by the partners.

Proposals which are signed for a corporation shall have the correct corporate name thereof and the signatures of the president or other authorized officers of the corporation manually written below the corporate name following the word "By." If such a Proposal is manually signed by an officer other than the president of the corporation, a certified copy of a resolution of the Board of Directors evidencing the authority of such official to sign the Proposal shall be attached to it. Such a Proposal shall also bear the attested signature of the secretary of the corporation and the impression of the corporate seal.

All Bidders shall complete the enclosed form entitled "Legal Status of Bidder."


The Bidder to whom an Award is made will be required to enter into a written Agreement in the form hereto annexed, within ten (10) days, Sundays and legal holidays excepted, after being notified of the acceptance of his/her Proposal and receipt by him/her of copies of the Contract Documents to be executed.

In case of failure to comply with this requirement, he/she shall be considered to have abandoned all rights and interest in the Award, his/her Proposal Guaranty may be declared forfeited to the OWNER and the Contract may be awarded to another.


The successful Bidder will be required to carry insurance in the amounts and kinds specified in the General Conditions. Such insurance must be with companies and in a form satisfactory to the OWNER, and certificates of such insurance must be attached to each copy of the executed Contract Documents.

These certificates shall contain a provision that coverage afforded under the policies will not be canceled or materially changed until at least fifteen (15) days prior written notice has been given to the OWNER and OWNER'S REPRESENTATIVE, as evidenced by return receipt or registered or certified mail.


The successful Bidder will be required to furnish for each set of the executed Contract Documents and conformed copies thereof, an original conformed Performance Bond, and Labor and Material Bond on the forms attached hereto with a surety acceptable to the OWNER, as follows:

1) Performance Bond in the amount of One Hundred Percent (100%) of the Contract Price to insure the completion of the entire Project according to the Contract Documents.

2) Labor and Material Bond in the amount of One Hundred Percent (100%) of the Contract Price for the protection of the OWNER and to secure payments of all labor, materials and subcontractors according to the statute of the state at that time in effect.


The successful Bidders documents shall comply with all state and local construction requirements and shall comply with all local building codes and inspection requirements.


The successful Bidder shall comply with the Health and Safety Regulations, Chapter XVII of Title 29 CFR, Part 1926, as promulgated by the Department of Labor and/or applicable State and local safety and health regulations. All questions regarding compliance and enforcement, as well as requests for the regulations should be directed to the Department of Labor and/or local agencies.


The successful Bidder documents shall comply with all local and state regulations and be in accordance with all applicable regulations, standards and specifications as adopted by the local enforcing agencies.
