Board of Zoning Appeals

A Regular Meeting of the Village of Lake Orion Board of Zoning Appeals will be held on THURSDAY, APRIL 4, 2013, at 7:30 p.m. in the Council Chambers of the Lake Orion Village Hall, 37 E. Flint St., Lake Orion, MI 48362

The following application for Zoning Ordinance variances will be considered:

Case No. A-13-01

Property Address: 317 Park Ave. (Kleparek)

Proposal: The applicant proposes to remove the existing 2nd story and construct a new 2nd story addition (approx. 1,094 sq. ft.) on the existing residence, with a 2nd floor balcony on the lakeside. The proposal requires four (4) variances from the Zoning Ordinance, as follows:.

1. Front (Street) Yard Setback

25.00 ft. required

15.18 ft. existing (to overhang)

15.18 ft. proposed (to 2nd story addition overhang)

9.82 ft. variance requested

2. Side (south) Yard Setback

5.00 ft. required

1.99 ft. existing (to overhang)

1.99 ft. proposed (to 2nd story addition overhang) 3.01 ft. variance requested

3. Increase in Nonconformity Construct a 2nd story addition not meeting Ordinance standards.

4. Structurally alter an existing nonconforming structure when cost exceeds 50% of the TCV of structure and foundation.

Cost of Improvements $62,321 permitted

$70,000 proposed

$7,679 variance requested

Property Address: 191 North Shore Dr. (LeMire)

Proposal: To construct a new deck addition (91 sq. ft.) onto an existing dwelling and deck on the north side of the existing dwelling. The proposal requires two (2) variances from the Zoning Ordinance, as follows:

1. Side (Street) Yard Setback

10.00 ft. required

6.80 ft. existing (to overhang on north side of dwelling)

8.00 ft. proposed (to edge of deck)

2.00 ft. variance requested

2. Increase in Nonconformity Construct an attached deck addition not meeting Ordinance standards.
