ZONING BOARD OF APPEALS
A Regular Meeting of the Charter Township of Oxford Zoning Board of Appeals will be held on Monday, August 12, 2013 at 7:00 p.m. in the evening, at the Oxford Veterans' Memorial Civic Center (2nd floor), 28 N. Washington, Oxford, MI 48371, to consider the following request:
ZBA003.13, P04-35-451-087 thru -098; 04-35-451-111 thru -146; 04-35-451-159 thru -242 Hills of Oxford/ Review of 4th, 5th and 6th Amendments to Master Deed
Request: to waive the requirement that the 4th, 5th and 6th Amendments to the Master Deed of Hills of Oxford, which include revisions to the site condominium plan, be approved by the Planning Commission.
The subject property is located on the east side of Lapeer Road, in the Multiple Family (RM) Zoning District within the Township of Oxford, Michigan.
Approval of this application, as submitted, would require variance(s) according to Zoning Ordinance 67(A):
Article 13 Condominium Regulations
Section 13.8 A(3) (requiring future changes made to the master deed be approved by the Planning Commission pursuant to Section 13.9(I))
Section 13.8 B(1) (requiring a determination by the Planning Commission that there be no contradiction in the master deed with any requirement of the Condominium Act (P.A. 59 of 1978))
Section 13.9(I) (requiring review and approval by the Planning Commission of an amendment to a master deed that affects the approved Final Site Plan, or any conditions of approval of the Final Site Plan, and requiring such an amendment to be approved before a building permit may be issued).
The Charter Township of Oxford will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audiotapes of printed materials being considered at the meeting/hearing.
