The Charter Township of Orion Zoning Board of Appeals will hold a public hearing on Monday, July 14, 2014 at 7:00 p.m. in the lower level of the Orion Township Hall, 2525 Joslyn Road, Lake Orion, Michigan 48360, on the following matter:

AB-2014-26, Brick It Up/Gary Bruce, 948 S. Baldwin Road, Sidwell #09-07-477-012

The petitioner is requesting a variance from Sign Ordinance No. 138, Section 8, Schedule B, Sign Setback, RB-3, requesting a 17-foot variance from the required 20-foot setback from the road right-of-way to install a sign 3 feet from the road right-of-way (north).

AB-2014-29, Shelley and Rick Peek, 461 Bristol Lane, Sidwell #09-07-252-001

The petitioner is seeking one interpretation and two variances from Zoning Ordinance No. 78:

1. Interpretation if the language in Article V, Section 5.02, B, "A garage" means a single (one) garage.

2. Article XXVII, Section 27.02, A, 8, Lot Size 1 to 2.5 acres , Maximum Floor Area of Attached Accessory Buildings (75% of principal structure): requesting a variance of 23% above the allowed 75% , the attached accessory buildings totaling 98% the size of the principal structure.

3. Article XXVII, Section 27.02, A, 8, Lot Size 1 to 2.5 acres, Total Maximum Floor Area of All Accessory Buildings: requesting a 756-square foot variance above the allowed 1,500-square foot maximum floor area of all accessory buildings to construct a second attached garage (1,440-square feet), resulting in a total maximum floor area of all accessory buildings equaling 2,256 square feet.

1. Article VI, 6.07, R-3, Minimum Lot setbacks, Front Yard, requesting a 14-foot variance from the required 30-foot front yard setback to construct a home 16 feet from the front property line (northwest).

2. Article VI, 6.07, R-3, Minimum Lot setbacks, Rear Yard, requesting a 10-foot variance from the required 35-foot rear yard setback to construct a home 25 feet from the rear property line (lakeside).

3. Article XXVII, 27.03, C, Projections Into Required Yards, requesting a 5-foot variance from the required 20-foot shoreline setback to construct a deck 15 feet from the shoreline.

The petitioner is requesting 8 variances from Zoning Ordinance No. 78, to construct an addition to an existing nonconforming boathouse and add a second-floor balcony to the existing portion of the nonconforming structure:

1. Article XXVII, Section 27.01, F, requesting a variance to alter a nonconforming structure.

2. Article XXVII, Section 27.01, G, requesting a variance to do repairs on a nonconforming structure.

3. Article XXVII, Section 27.17, B, All structures or buildings, requesting a 25-foot variance from the required 25-foot wetland setback to construct an addition zero feet from the property line (north).

4. Article XXVII, Section 27.17, B, All structures or buildings, requesting 25-foot variance from the required 25-foot wetland setback to add a second-story balcony to an existing nonconforming structure, zero feet from the property line (south).

5. Article XXVII, Section 27.17, B, All structures or buildings, requesting a 10-foot variance from the required 25-foot wetland setback to construct an addition, 15 feet from the property line (south).

6. Article VI, Section 6.07, R-3, Minimum Lot Setbacks, Rear Yard, requesting a 35-foot variance from the required 35-foot rear yard setback to construct an addition zero feet from the rear property line (north).

7. Article VI, Section 6.07, R-3, Minimum Lot Setbacks, Rear Yard, requesting a 20-foot variance from the required 35-foot rear yard setback to construct an addition 15 feet from the rear property line (south).

8. Article VI, Section 6.07, R-3, Minimum Lot Setbacks, Rear Yard, requesting a 5-foot variance from the required 35-foot rear yard setback to construct an addition 30 feet from the rear property line (east).
