The Charter Township of Orion Zoning Board of Appeals will hold a public hearing on Monday, June 14, 2010 at 7:00 p.m. in the lower level of the Orion Township Hall, 2525 Joslyn Road, Lake Orion, Michigan 48360, on the following matter:

AB-2010-13A, WT Development Corp. for Taco Bell of America, Inc., 4885 S. Baldwin Road

The Petitioner is seeking 5 variances from Ordinance No. 78, to construct a 2,900-square foot Taco Bell Drive-Thru Restaurant:

1) Article 14.02, F, 1 — A 12-foot variance from the required 50-foot setback between the rear parking lot and the lot line of a single-family parcel.

2) Article 14.02, F, 1 — A 36-foot variance from the required 50-foot setback between the maneuvering lane and the lot line of a single-family parcel.

3) Article 14.02, F, 1 — A 52-foot variance from the required 100-foot setback between the speaker box and the lot line of a single-family parcel.

4) Article 14.02, F, 1 — A 30-foot variance from the required 100-foot setback between the building and the lot line of a single-family parcel.

5) Article 14.04, E, 2 — A 16-foot variance from the required 30-foot landscape greenbelt width along perimeter abutting single-family parcel.

The petitioner is seeking two variances from Zoning Ordinance No. 78:

1) Section 27.02,A,4, a six-foot variance from the required ten-foot rear yard setback; and,

2) Section 27.01,C,1,b, (see chart, 60-65 feet) and Section 27.02,A,4, a 5.5-foot variance from the required eight-foot side yard setback (north side) for a partially constructed detached accessory building (shed).

2) Section 8, B, GB-1 — A variance of 19.9 feet from the required 30-foot road right-of-way setback for a monument sign.

3) Section 8, B, GB-1, wall sign — A variance for three additional wall signs above the allowed one wall sign.

4) Section 8, B, GB-1, wall sign — A variance of 18.42 square feet over the allowed 40 square feet of sign area for a wall sign(s).

1) A 13.37-foot variance from the required 30-foot front yard setback; and,

2) A 7.7-foot variance from the required 35-foot rear yard setback.
