Board of Zoning Appeals

A Regular Meeting of the Village of Lake Orion Board of Zoning Appeals will be held on THURSDAY, AUGUST 5, 2010, at 7:30 p.m. in the Council Chambers of the Lake Orion Village Hall, 37 E. Flint St., Lake Orion, MI 48362.

The following applications for Zoning Ordinance variances will be considered:

Case No. A-10-05

Property Address: 356 Newton Dr. (McCoy)

NOTE: This Case is being re-noticed and will be heard at the August 5, 2010 meeting to address an improper procedure that occurred at the July 1, 2010 Board of Zoning Appeals meeting.

Proposal: The applicant proposes to construct a 20' x 30' (600 sq. ft.), single story detached garage in approximately the same location on the north property line as a nonconforming garage that was destroyed by fire requiring two (2) variances from the Zoning Ordinance, as follows:

1. To permit the garage to be located within the Required Side Yard area when the Ordinance specifically prohibits the location of any accessory building in any Required Front or Side Yard areas.

1. To permit a nonconforming structure to be enlarged or structurally altered when such modifications do not conform to the provisions of the Zoning Ordinance.

2. To enlarge or structurally alter an existing nonconforming building.

Proposal: The applicant proposes to construct a 336 sq. ft., irregularly shaped second story addition on a portion of the existing nonconforming building. The applicant is also requesting waiver of the Site Plan submittal, review and approval requirements for the proposed addition. The request will require twelve (12) variances from the Zoning Ordinance as follows:

1. To permit a nonconforming structure to be enlarged or structurally altered when such modifications do not conform to the provisions of the Zoning Ordinance.

2. To enlarge or structurally alter an existing nonconforming building.

3. To permit the separation of two (2) lots with continuous frontage in single ownership, when such lots do not individually meet the lot width requirements.

8. To permit the Village Administration to determine what information is required for the Site Plan, when the Ordinance grants such authority only to the Planning Commission.

9. To permit the Village Administration to modify the lighting standards if necessary, when the Ordinance grants such authority only to the Planning Commission.

10. To allow a 5 foot high screen fence along the east property line when the Ordinance allows fences in non-residential districts only for the purpose of enclosing outside storage of goods, material and equipment.

11. To allow a gravel surface for the parking area, when the Ordinance requires a paved surface for all off-street parking lots.

Proposal: The applicant proposes to replace an existing smaller porch with a 271.9 sq. ft. open covered porch (approximately 28.4' x 7.8') with steps (approximately 4' x 12.2') on the Lakeside of an existing nonconforming dwelling requiring five (5) variances from the Zoning Ordinance, as follows:

1. To permit a nonconforming structure to be enlarged or structurally altered when such modifications do not conform to the provisions of the Zoning Ordinance.

2. To enlarge or structurally alter an existing nonconforming building.
