ORDINANCE # 135-11 AMENDMENT TO CHAPTER 40 OF THE CODE OF ORDINANCES
CHARTER TOWNSHIP OF BRANDON
PREAMBLE
The Board of Trustees of the Township of Brandon has determined that the current code of ordinances Chapter 40, Article VI, Section 40-139 regarding penalties be revised, and it is appropriate for the health, safety and welfare of the citizens of the Township that the Code be amended accordingly.
THE CHARTER TOWNSHIP OF BRANDON, OAKLAND COUNTY, MICHIGAN ORDAINS:
That the Code of Ordinances, Charter Township of Brandon, Oakland County, Michigan Chapter 40 is hereby amended as follows:
1. Section 40-139 of this Code of Ordinances as adopted August 2, 2010 is hereby repealed.
2. New Chapter 40, Art. VI, Section 40-139 is hereby adopted:
Sec. 40-139 Violations
All penalty provisions set forth in MCL 324.81101 et seq. that do not exceed Ordinance authorization Chapter 1, Section 1-11 shall apply.
SEVERABILITY
The invalidity of any clause, sentence, paragraph or part of this Ordinance shall not affect the validity of the remaining parts of this Ordinance.
PUBLICATION
The Clerk for the Charter Township of Brandon shall cause this Ordinance to be published in the manner required by the Michigan Zoning Enabling Act, Act 110 of 2006 as amended and MCL 42.22.
EFFECTIVE DATE
This Ordinance shall be effective immediately upon publication.
CERTIFICATION
The forgoing Ordinance was duly adopted by the Board of Trustees of the Charter Township of Brandon at its regular meeting called and held on the 5th day of July, 2011 and was ordered to be given publication in the manner required by law.
