NOTICE OF PUBLIC HEARING

The Charter Township of Orion Zoning Board of Appeals will hold a public hearing on Monday, September 26, 2011 at 7:00 p.m. in the lower level of the Orion Township Hall, 2525 Joslyn Road, Lake Orion, Michigan 48360, on the following matter:

AB-2011-22. Mike Aziri. 1312 Holliday Drive. Sidwell #09-01-480-001

The Petitioner is seeking 2 variances from Zoning Ordinance No. 78:

1. Article XXVII, Section 27.01, F. 1 -- Requesting a variance to enlarge a nonconforming structure which would result in an increase in the structure's nonconformity, in order to build an attached garage.

2. Article VI, Section 6.07, R-3 Zoning, Minimum Lot Setback Rear Yard - Requesting a 29-foot rear yard setback variance, from the required 35-foot rear yard setback, in order to build an attached garage 6 feet from the rear lot line.

You may send correspondence regarding this case to the Orion Township Hall, addressed to the Zoning Board of Appeals, or you may attend the public hearing to express your views and/or concerns.

A complete copy of the proposed ZBA application is on file in the Building Department Office and may be examined during normal business hours, 8:30 a.m. to 4:30 p.m., Monday through Friday, until the date of the public hearing.

AB-2011-23, Joseph Muller, 851 Fairview Ave., Sidwell 09-03-452-038

The Petitioner is seeking 5 variances from Zoning Ordinance No. 78:

1. Article VI, Section 6.07, R-3 Zoning District, Minimum Lot Setbacks, Each Side Yard — requesting a 4-foot side yard setback variance from the required 10-foot side yard setback (west side) in order to build a home that is 6 feet from the west property line.

2. Article VI, Section 6.07, R-3 Zoning District, Minimum Lot Setbacks, Each Side Yard requesting a 4-foot side yard setback variance from the required 10-foot side yard setback (east side) in order to build a home that is 6 feet from the east property line.

3. Article VI, Section 6.07, R-3 Zoning District, Maximum Lot Coverage — requesting a 1.5% variance over the allowed 25% of Maximum Lot Coverage to build a house and detached accessory building with a maximum lot coverage equaling 26.5%.

4. Article XXVII, Section 27.02, A, 8, Lot Size Up to Acre, Maximum Floor Area Of Detached Accessory Buildings — requesting a 930 square foot variance, over the allowed 750 square feet of Maximum Floor Area Of Detached Accessory Buildings, to build a 1,680 square foot detached accessory building.

5. Article XXVII, Section 27.02, A, 8, Lot Size Up to Acre, Total Maximum Floor Area Of All Accessory Buildings requesting a 968 square foot variance, over the allowed 1,150 square feet of Total Maximum Floor Area Of All Accessory Buildings, to build a 438 square foot attached garage and a 1,680 square foot detached accessory building that would result in Total Maximum Floor Area Of All Accessory Buildings equaling 2,118 square feet.
