CHARTER TOWNSHIP OF ORION

ADOPTION OF ORDINANCE 134-1

AMENDMENT TO ORDINANCE NO. 134 STATE VEHICLE CODE

The Charter Township of Orion Board of Trustees, at the regular meeting of Monday, April 18, 2011, held at 7:00 p.m., at the Orion Township Hall, 2525 Joslyn Rd., Lake Orion, Michigan 48360, adopted an ordinance to readopt the Michigan Vehicle Code 1949 PA 300 MCL 247.1 et seq. as amended at the time of the adoption and as may be amended in the future.

The CHARTER Township of ORION OrdainS:

SECTION 1 of Ordinance

The Preamble of Ordinance No. 134 shall be amended by replacing and modifying the existing language with the hereinafter described language in the Ordinance as follows:

An Ordinance to ADOPT BY REFERENCE THE MICHIGAN VEHICLE CODE (MVC), MCL 257.1, ET SEQ., AS AMENDED AT THIS TIME OR AS MAY BE AMENDED IN THE FUTURE, FOR THE PURPOSE OF REGULATING TRAFFIC AND MOTOR VEHICLES IN THE CHARTER TOWNSHIP OF ORION.

SECTION 2 of Ordinance

Section 1 of Ordinance No. 134 shall be amended by modifying the existing language with the hereinafter described language in the Ordinance as follows:

Section 1 - Purpose and Intent

This Ordinance is adopted for the purpose and intent to adopt by reference the Michigan Vehicle Code, 1949 PA 300, MCL 257.1, et seq., as amended, at this time or as may be amended in the future, for the purpose of regulating traffic and motor vehicles in the Charter Township of Orion.

SECTION 3 of Ordinance

Section 2 of Ordinance No. 134 shall be amended by modifying the existing language with the hereinafter described language in the Ordinance as follows:

Section 2 - Adoption of Michigan Vehicle Code

The Charter Township of Orion hereby ordains that the Michigan Vehicle Code, 1949 PA 300, MCL 257.1 et seq., as amended at this time or as may be amended in the future, is hereby adopted for the purpose of regulating traffic and motor vehicles in the Charter Township of Orion.

SECTION 4 of Ordinance

Section 8 of Ordinance No. 134 shall be amended by replacing the existing language with the hereinafter described language in the Ordinance as follows:

Section 8 - Severability

The various parts, sections and clauses of this Ordinance are declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of the Ordinance shall not be affected.

SECTION 5 of Ordinance

Section 9 of Ordinance No. 134 shall be amended by replacing the existing language with the hereinafter described language in the Ordinance as follows:

Section 9 - Effective Date and Publication

This Ordinance shall be published in full in a newspaper of general circulation in the Charter Township of Orion, qualified under State law to publish legal notices, and shall become effective as provided by law.

This Ordinance is hereby declared to have been adopted by the Board of Trustees of the Charter Township of Orion at a meeting thereof duly called and held on the 18th day of April, 2011, and ordered to be given publication in the manner prescribed by the Charter of the Township of Orion.

Copies of the Ordinance are on file in the office of the Township Clerk, 2525 Joslyn, Lake Orion, Michigan, 48360, and may be examined during normal business hours, 8:30 a.m. to 4:30 p.m., Monday through Friday.
