NOTICE OF PUBLIC HEARING

The Charter Township of Orion Zoning Board of Appeals will hold a public hearing on Monday, July 11, 2011 at 7:00 p.m. in the lower level of the Orion Township Hall, 2525 Joslyn Road, Lake Orion, Michigan 48360, on the following matter:

AB-2011-13, Real Estate Gives, 109 Indianwood Road, Sidwell #09-02-177-006

The Petitioner is seeking four variances from Zoning Ordinance No. 78, Article XII:

1. Section 12.04, D, 4 – Requesting an 11.31-foot variance from the required 30-foot distance between the proposed off-street parking and the west property line (abutting residentially-zoned property).

2. Section 12.04, E, 2 – Requesting an 11.31-foot variance from the required 30-foot greenbelt (west side abutting residentially-zoned property).

3. Section 12.04, D, 4 – Requesting a 6.70-foot variance from the required 20-foot distance between the proposed off-street parking and the east property line 4. Section 12.04, D, 4 – Requesting a 1.10-foot variance from the required 20-foot distance between the proposed off-street parking and the north property line (abutting Indianwood Road).

You may send correspondence regarding this case to the Orion Township Hall, addressed to the Zoning Board of Appeals, or you may attend the public hearing to express your views and/or concerns.

A complete copy of the proposed ZBA application is on file in the Building Department Office and may be examined during normal business hours, 8:30 a.m. to 4:30 p.m., Monday through Friday, until the date of the public hearing.

The Petitioner is seeking two variances from Zoning Ordinance No. 78, Article XXVII: Section 27.02, A, 4; Section 27.05, H, 2; and, Section 27.01, C, 1, b – Lot Width 60 to 65 feet;

1. Requesting a 10-foot rear yard setback variance to install a 6-foot, in height, privacy fence on the west property line (zero setback).

2. Requesting two 8-foot side yard setback variances to install a 6-foot, in height, privacy fence on the north and south lot lines (zero setback).
