ORDINANCE # 134-11 AMENDMENT TO CHAPTER 32 OF THE CODE OF ORDINANCES

CHARTER TOWNSHIP OF BRANDON

PREAMBLE

The Board of Trustees of the Township of Brandon has determined that the current code of ordinances Section 32-23 omits certain clarifying language regarding penalties and it is appropriate for the health, safety and welfare of the citizens of the Township that the Code be amended accordingly.

THE CHARTER TOWNSHIP OF BRANDON, OAKLAND COUNTY, MICHIGAN ORDAINS:

That the Code of Ordinances, Charter Township of Brandon, Oakland County, Michigan Chapter 32, Article II, is hereby amended as follows:

1. Section 32-23 of this Code of Ordinances as adopted August 2, 2010 is hereby repealed.

2. New Chapter 32, Art. II, Section 32-23 is hereby adopted:

Sec. 32-23 Penalties

Violation of Article II of Section 32-21, Sub-Section(s) (3), (19), (20) is a civil infraction.

A person in violation of any other section of Art. II shall be subject to either or both of the following, at the discretion of the Court:

(1) Ejectment from park by the enforcement official

(2) Misdemeanor arrest and/or citation

SEVERABILITY

The invalidity of any clause, sentence, paragraph or part of this Ordinance shall not affect the validity of the remaining parts of this Ordinance.

PUBLICATION

The Clerk for the Charter Township of Brandon shall cause this Ordinance to be published in the manner required by the Michigan Zoning Enabling Act, Act 110 of 2006 as amended and MCL 42.22.

EFFECTIVE DATE

This Ordinance shall be effective immediately upon publication.

CERTIFICATION

The forgoing Ordinance was duly adopted by the Board of Trustees of the Charter Township of Brandon at its regular meeting called and held on the 5th day of July, 2011 and was ordered to be given publication in the manner required by law. B. Jean McCreery, CMC
