AMENDING ORDINANCE #138-12
Amending Ordinance to the Code of Ordinances, Accessory Building Ordinance adopted August 2, 2010, by revising Article IV General Regulations, Section 46-242 (1) d. 5. Attached accessory structures.
PREAMBLE
THE CHARTER TOWNSHIP OF BRANDON, OAKLAND COUNTY, MICHIGAN ORDAINS: that the current code of ordinances Article IV, Section 46-242 (1) d. 5. Attached accessory structures be amended, and it is appropriate for the health, safety and welfare of the citizens of the Township that the Code be amended accordingly.
Revision to Article IV, Section 46-242 (1) d. 5. Attached accessory structures to read as follows:
5. The total area of all attached accessory buildings in the RE district shall not exceed the total square footage of the living area of the principle building or a maximum of 1,000 square feet.
The total area of all detached accessory buildings in the RE district shall not exceed the total square footage of the living area of the principle building less the existing attached accessory building or 1,200 square feet, whichever is greater. The square footage of finished or unfinished basements shall not be considered when determining accessory building area. The area of detached accessory buildings may be increased by 400 square foot for each acre over 2.5 acres where additional acreage is part of a single lot or parcel.
SEVERABILITY
The invalidity of any clause, sentence, paragraph or part of this Ordinance shall not affect the validity of the remaining parts of this Ordinance.
PUBLICATION
The Clerk for the Charter Township of Brandon shall cause this Ordinance to be published in the manner required by the Michigan Zoning Enabling Act, Act 110 of 2006 as amended and MCL 42.22.
EFFECTIVE DATE
This Ordinance shall be seven (7) days after publication, February 18, 2012
CERTIFICATION
The forgoing Ordinance was duly adopted by the Board of Trustees of the Charter Township of Brandon at its regular meeting called and held on the 6th day of February, 2012 and was ordered to be given publication in the manner required by law.
